1. General Information

This online store at nevorest.com is operated by Nevorest. You can contact us at support@nevorest.com.

Operating as an unregistered business activity under Article 5 of the Polish Entrepreneurs' Law Act of March 6, 2018.

These Terms of Service ("Terms") govern your use of the Nevorest website and your purchase of products through it. By placing an order, you agree to these Terms.

2. Products

Nevorest offers physical products including pillows and home accessories. We reserve the right to modify our product range at any time without prior notice.

All product descriptions, images, and prices are provided in good faith. Minor differences in color between product photos and actual items may occur due to monitor settings.

3. Orders and Contract Formation

A contract between you and Nevorest is formed when:

1. You place an order through our website, and
2. You receive an order confirmation email from us.

We reserve the right to refuse or cancel any order at our discretion, in which case you will receive a full refund.

4. Prices and Payment

All prices are displayed in the currency shown on the website and include applicable taxes unless stated otherwise.

We accept the following payment methods:

• Credit and debit cards (Visa, Mastercard)
• BLIK
• Other methods available at checkout

Payment is processed securely via Stripe. We do not store your payment details.

Prices may change at any time, but changes will not affect orders already confirmed.

5. Shipping

We ship globally. Shipping costs and estimated delivery times are displayed at checkout before you complete your purchase.

Delivery times are estimates only and may vary due to factors outside our control (customs, carrier delays, etc.). We are not liable for delays caused by third-party carriers.

Risk of loss and title to products passes to you upon delivery.

Our products are shipped internationally. Delivery times may vary and typically range from 7 to 30 business days depending on your location and customs processing times.

International orders may be subject to customs duties, import taxes, or other fees imposed by your country. These charges are the sole responsibility of the customer. We have no control over these charges and cannot predict their amount.

If a package is refused or unclaimed by the customer and returned, the customer will be responsible for the original shipping cost and any return shipping fees incurred. These costs will be deducted from any refund.

6. Right of Withdrawal (EU / EEA Customers)

If you are a consumer residing in the European Union or European Economic Area, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason.

To exercise this right:
Contact us at support@nevorest.com before the 14-day period expires, clearly stating your intent to withdraw and your order number.

Return shipping:
You are responsible for the cost of returning the product unless we have agreed otherwise or the product is defective.

Refund:
We will refund the full product price, including standard shipping costs you paid, within 14 days of receiving your withdrawal notice, or within 14 days of receiving the returned product (whichever is later). Refunds are issued using the same payment method you used.

Exceptions — the right of withdrawal does not apply to:

• Products made to your specifications or clearly personalized
• Sealed products that are not suitable for return due to health or hygiene reasons, if unsealed after delivery
• Products that, after delivery, have been mixed inseparably with other items

Important conditions for exercising the right of withdrawal:

• The customer is responsible for all return shipping costs unless the product is defective or incorrect. We do not provide prepaid return labels.
• Products must be returned in their original, unused, and undamaged condition with all original packaging intact. We reserve the right to refuse a return or deduct the loss in value from the refund if the product shows signs of use or damage caused by the customer.
• Pillows, cushions, and any other bedding or textile products are considered hygiene-sensitive items. If the original sealed packaging has been opened, these products are exempt from the right of withdrawal under Article 16(e) of EU Directive 2011/83/EU and cannot be returned.
• The customer must contact us at support@nevorest.com before sending any return. Returns sent without prior authorization will not be accepted and may be returned to the sender at their expense.
• The return address will be provided by us upon approval of the return request. Do not return products to the address shown on the original package.

7. Returns and Refunds (Non-EU Customers)

If you are not an EU/EEA consumer, our return policy is as follows:

We accept returns within 14 days of delivery for items that are:

• Unused and in original condition
• In original packaging

Return shipping costs are the responsibility of the buyer unless the item is defective or incorrect.

8. Defective or Incorrect Products

If you receive a defective or incorrect product, please contact us at support@nevorest.com within 14 days of delivery. We will arrange a replacement or refund at no additional cost to you.

9. Complaints

We aim to respond to all complaints within 14 business days. To submit a complaint, email us at support@nevorest.com with your order number and a description of the issue.

10. Liability

To the fullest extent permitted by applicable law, Nevorest shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profit or data arising from the use of our products or website

Our total liability for any claim shall not exceed the amount paid for the relevant product.

Nothing in these Terms limits or excludes liability that cannot be excluded under applicable law, including consumer protection rights.

11. Intellectual Property

All content on nevorest.com, including logos, images, text, and design, is the property of Nevorest or its licensors. You may not reproduce, distribute, or use any content without our prior written consent.

12. Governing Law

These Terms are governed by the laws of the Republic of Poland. However, if you are a consumer in another country, you also benefit from any mandatory consumer protection laws applicable in your country of residence.

Any disputes that cannot be resolved amicably shall be subject to the jurisdiction of the competent courts in Poland.

13. Changes to These Terms

We may update these Terms at any time. The current version will always be available on our website. Continued use of our website after changes constitutes acceptance of the updated Terms.
